Governor Asa Hutchinson Announces Intent to Grant Executive Clemency

LITTLE ROCK – Governor Asa Hutchinson today announced his intent to grant nine pardons and two commutations. An additional 40 clemency requests were denied and four had no action taken upon them. These include requests from both inmates and non-inmates.

The applicants intended for pardons have completed all jail time, fulfilled all parole and probationary requirements and paid all fines related to their sentences. There is a 30-day waiting period to receive public feedback on the notices before final action is taken.

Governor Hutchinson intends to grant pardons to the following people:

Rodrick Crawford (Little Rock): Possession of a Controlled Substance with Intent to Deliver, Marijuana (C Felony).

This notice is issued based on the date of conviction (2007 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Laure Melissa Shankle Drummond (Batesville): Theft of Property, two counts (B Felony). 

This notice is issued based on the date of conviction (2003 – Independence County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Johnathan Dunn (Newport): Theft of Property (A Misdemeanor) and Breaking or Entering (D Felony).

This notice is issued based on the date of conviction (2005 – Jackson County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Christopher R. Ferrand (Bryant): Disorderly Conduct (C Misdemeanor) and Beer Overpossession in a Dry Territory (Unclassified).

This notice is issued based on the dates of conviction (2001 and 2002 – Faulkner County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. The Prosecuting Attorney has raised objections to the application.

Nicholas A. Fitzpatrick (Ward): Theft by Receiving (C Felony).        

This notice is issued based on the date of conviction (1998 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Travis Parcher (Bakersfield, CA): Possession of a Controlled Substance with Intent to Sell/Deliver (C Felony).      

This notice is issued based on the date of conviction (2000 – Crittenden County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Kevis D. White (Little Rock): Possession of a Controlled Substance, Marijuana, Second Offense (D Felony). 

This notice is issued based on the date of conviction (2002 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Jason N. Whitney (Cabot): Manufacturing, Delivery or Possession of a Controlled Substance (C Felony), Delivery, Possession or Manufacturing of Drug Paraphernalia (C Felony) and Battery, Second Degree (D Felony).

This notice is issued based on the dates of conviction (1998 and 2001 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Thomas L. Wise (England): Possession of Marijuana with Intent to Deliver (C Felony).

This notice is issued based on the date of conviction (2001 – Lonoke County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Governor Hutchinson intends to grant commutations to the following people:

Herbert P. Malone (ADC #086888): Aggravated Robbery (Y Felony), Aggravated Assault (D Felony) and Theft of Property (B Felony) (Jury Trial).

The governor has given notice of his intent to commute the sentence of Herbert P. Malone, who was convicted in Pulaski County in 1986 for the above offense, from a term of 348 years in the Arkansas Department of Correction to become immediately parole eligible. The Sheriff has raised objections to the application.

Johnny E. Morgan (ADC #093350): Manufacturing Methamphetamine (Habitual Offender) (Y Felony), Possession of Drug Paraphernalia with Intent to Manufacture Methamphetamine (Habitual Offender) (B Felony), Endangering the Welfare of a Minor, First Degree (Habitual Offender) (D Felony), Manufacturing Methamphetamine in the Presence of a Minor (Enhancement) and Manufacturing near Certain Facilities (Enhancement) (Jury Trial).

The governor has given notice of his intent to commute the sentence of Johnny E. Morgan, who was convicted in Scott County in 2007 for the above offenses, from a term of 480 months in the Arkansas Department of Correction to a term of to 240 months. The Prosecuting Attorney has raised objections to the application.
