Governor Asa Hutchinson Announces Intent to Grant Executive Clemency

LITTLE ROCK – Governor Asa Hutchinson today announced his intent to grant four pardons and one commutation. An additional 47 clemency requests were denied and five had no action taken upon them. These include requests from both inmates and non-inmates.

The applicants intended for pardons have completed all jail time, fulfilled all parole and probationary requirements and paid all fines related to their sentences. There is a 30-day waiting period to receive public feedback on the notices before final action is taken.

Governor Hutchinson intends to grant pardons to the following people:

Jerry R. Byars (Charlotte): Delivery of Controlled Substance, Marijuana, two counts (C Felony). 

This notice is issued based on the date of conviction (2001 – Independence County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application. 

Tony Ellis (Rover): Fleeing (D Felony). 

This notice is issued based on the date of conviction (1996 – Polk County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application. 

Jimmy R. Kelley, II (Lonoke): Possession of Drug Paraphernalia (C Felony) and Criminal Attempt to Deliver a Controlled Substance, Marijuana (D Felony). 

This notice is issued based on the date of conviction (2006 – Lonoke County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application. 

Walton J. Summers, II (Lonoke): Manufacture of Controlled Substance (C Felony). 

This notice is issued based on the date of conviction (1986 – Lonoke County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application. 

Governor Hutchinson intends to grant commutation to the following person:

Robert Maldonado, II (ADC #111892): Hot Check Violation, seven counts (Probation Revocation) (C Felony). 

The governor has given notice of his intent to commute the sentence of Robert Maldonado, II, who was convicted in Pulaski County in 2008 for the above offense, from a total of 80 years to serve in the Arkansas Department of Correction to being immediately parole eligible. The Sheriff has raised objections to the application.
