Governor Asa Hutchinson Announces Intent to Grant Executive Clemency

LITTLE ROCK – Governor Asa Hutchinson today announced his intent to grant seven pardons and one commutation. An additional 52 clemency requests were denied and six had no action taken upon them. These include requests from both inmates and non-inmates.

The applicants intended for pardons have completed all jail time, fulfilled all parole and probationary requirements and paid all fines related to their sentences. There is a 30-day waiting period to receive public feedback on the notices before final action is taken.

Governor Hutchinson intends to grant pardons to the following people:

Kirby Dotter Cryoskie (Fort Wainwright, AK): Possession of a Controlled Substance, Cocaine (C Felony) and Possession of a Controlled Substance, Marijuana (C Felony).

This notice is issued based on the date of conviction (2002 – Baxter County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Thurman Hayes (Little Rock): Possession of a Controlled Substance with Intent to Deliver (C Felony), Possession of a Controlled Substance (C Felony), Possession of a Controlled Substance without Prescription (A Misdemeanor) and Possession of Drug Paraphernalia (C Felony).

This notice is issued based on the dates of conviction (1990, 1993 and 1998 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Michael R. Johnson (North Little Rock): Forgery, Second Degree (C Felony) and Obstruction of Governmental Operations (B Misdemeanor).

This notice is issued based on the date of conviction (2004 – Lonoke County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Ray A. Plummer (Little Rock): Theft by Receiving (D Felony) and Possession of Cocaine with Intent to Deliver (Y Felony). 

This notice is issued based on the dates of conviction (1985 – Jefferson County and 1999 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Kelvin G. Sanders (Fouke): Burglary and Grand Larceny, three counts (Felony).

This notice is issued based on the date of conviction (1975 – Miller County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. The Miller County Prosecutor has raised objections to the application.

Richard K. Simpson (Manila): Theft of Property, two counts (C Felony).

This notice is issued based on the dates of conviction (2000 – Mississippi and Poinsett County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Douglas J. Smith (McCrory): Possession of a Controlled Substance (C Felony) and Theft by Receiving (A Misdemeanor).

This notice is issued based on the dates of conviction (1997 and 2002 – Woodruff County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Governor Hutchinson intends to grant commutation to the following person:

Jeremy J. Francis (ADC #143122): Manufacture of a Controlled Substance, Methamphetamine (Y Felony) (Guilty Plea).

The governor has given notice of his intent to commute the sentence of Jeremy J. Francis, who was convicted in Benton County in 2008 for the above offense, from a term of 300 months in the Arkansas Department of Correction to a term of 240 months. The Benton County Prosecuting Attorney has raised objections to the application.
