Governor Asa Hutchinson Announces Intent to Grant Executive Clemency

LITTLE ROCK – Governor Asa Hutchinson today announced his intent to grant 6 pardons and 1 commutation. An additional 29 clemency requests were denied and 5 had no action taken upon them. These include requests from both inmates and non-inmates.

The applicants intended for pardons have completed all jail time, fulfilled all parole and probationary requirements and paid all fines related to their sentences. There is a 30-day waiting period to receive public feedback on the notices before final action is taken.

Governor Hutchinson intends to grant pardons to the following people:

Darrell Beck (Lonoke): Burglary (B Felony) and Theft Of Property (B Felony) (CR 90-02117).

This notice is issued based on the date of convictions (1991 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Edward S. Rodgers (Benton): Theft of Property (Felony) (CR-92-2160A).

This notice is issued based on the date of conviction (1992 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further felony criminal-law violations. There are no law enforcement objections to the application.

Eric Ryan (Van Buren): Failure to Appear on Battery 3rd Degree (A Misdemeanor) (case 02-2185).

This notice is issued based on the date of conviction (2002 – Crawford County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Robert Higgs (North Little Rock): Possession of a Controlled Substance (C Felony) (CR 00-117).

This notice is issued based on the date of conviction (2000 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further felony criminal-law violations. There are no law enforcement objections to the application.

Sheila R. Posey (Fort Smith): Hot Check Violation (Overdraft) (C Felony) (CR-94-941); Possession of Drug Paraphernalia (C Felony) (CR-94-962); Hot Check Violation (Revocation) (C Felony) (CR-94-941) and Possession of Drug Paraphernalia (Revocation) (C Felony) (CR-94-662).

This notice is issued based on the dates of convictions (1995, 1995 and 1996 – Sebastian County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Janice E. Smith (Newport): Theft of Property (C Felony) (CR 88-236); Violation of the Arkansas Hot Check Law (U Misdemeanor) (CR 2001-14).

This notice is issued based on the dates of convictions (1989 – Craighead County; 2001 – White County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Governor Hutchinson intends to grant a commutation of sentence to the following person:

Amanda G. Holt (­­­­#709644): Maintaining Drug Premises (D Felony), Expose Child to Chem Substance, 3 counts (C Felony), Man Cont Subs Meth (Y Felony) and Poss Drug Paraphernalia w/Intent to Man Meth (B Felony) (2007-0086) (Jury Trial); Man.Cont Subs Meth (Habitual Offender) (Y Felony), Poss Cont Subs w/Intent Meth (Habitual Offender) (Y Felony), Poss Drug Paraphernalia w/Intent to Man (Habitual Offender) (B Felony) and Use Another's Property to Facilitate a Crime (Habitual Offender) (B Felony) (2007-1208) (Guilty Plea).

The governor has given notice of his intent to commute the sentence of Amanda G. Holt, who was convicted in Pulaski County in 2007 for the above offenses, from a total of 612 months to serve in the Arkansas Department of Correction to making her immediately parole eligible. There are no law enforcement objections to the application.
