Governor Asa Hutchinson Announces Intent to Grant Executive Clemency

LITTLE ROCK – Governor Asa Hutchinson today announced his intent to grant 16 pardons. An additional 32 clemency requests were denied and 6 had no action taken upon it. These include requests from both inmates and non-inmates.

The applicants intended for pardons have completed all jail time, fulfilled all parole and probationary requirements and paid all fines related to their sentences. There is a 30-day waiting period to receive public feedback on the notices before final action is taken.

Governor Hutchinson intends to grant pardons to the following people:

Clinton W. Baxter (Benton): Possession of Marijuana with Intent to Deliver (C Felony) and Possession of Alprazolam with Intent to Deliver (C Felony) (CR 2004-075-1).

This notice is issued based on the date of convictions (2005 – Bradley County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application. 

Carl Breger (Lead Hill): Possession of Drug Paraphernalia, Possession of a Controlled Substance (Marijuana), Possession of a Controlled Substance (Valium), Driving under the Influence of a Controlled Substance, and Reckless Driving (CR 95-276). 

This notice is issued based on the date of convictions (1995 – Boone County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application. 

Brian Carlisle (Peoria, AZ): Commercial Burglary (C Felony) and Theft of Property (C Felony) (CR 2005-1594-1A).

This notice is issued based on the date of convictions (2006 – Benton County), the fact that all terms of the applicant’s sentence have been completed and there have been no further Arkansas criminal-law convictions. The Prosecuting Attorney has raised objections to applicant's request.

Tammi Derr (Huntington): Possession of Methamphetamine (C Felony) (CR 2002-95); Possession of Methamphetamine (Probation Revocation) (C Felony) (CR 2002-95).

This notice is issued based on the dates of convictions (2003 and 2003 – Scott County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Deborah Rooker Fotioo (Maumelle): Theft of Property (B Felony) (CR 98-2686).

This notice is issued based on the date of conviction (1999 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Marianne Higgins Gandolph (Hot Springs): Theft of Property (C Felony) and Forgery (C Felony) (CR 84-6).

This notice is issued based on the date of convictions (1984 – Drew County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Lamica Jackson (North Little Rock): Possession of a Controlled Substance with Intent to Deliver (Felony) and Drug Paraphernalia (Felony) (CR 95-2643C).

This notice is issued based on the date of convictions (1996 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further felony criminal-law violations. There are no law enforcement objections to the application.

Clayton Kannada (Stuttgart): Possession of Anhydrous Ammonia (B Felony) (CR 02-252), Possession of Drug Paraphernalia (C Felony) (CR 02-252), and Possession of Drug Paraphernalia (C Felony) (CR 03-5).

This notice is issued based on the date of convictions (2003 – Arkansas County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

James McCombs (Searcy): Theft of Property (C Felony) (CR 95-2643C).

George Douglas Mitchell (Leslie): Possession of Drug Paraphernalia with Intent to Use (C Felony) (CR 2000-261).
