Governor Asa Hutchinson Announces Intent to Grant Executive Clemency

LITTLE ROCK – Governor Asa Hutchinson today announced his intent to grant 14 pardons and 1 restoration of firearm rights only. An additional 45 clemency requests were denied and 2 had no action taken upon it. These include requests from both inmates and non-inmates.

The applicants intended for pardons have completed all jail time, fulfilled all parole and probationary requirements and paid all fines related to their sentences. There is a 30-day waiting period to receive public feedback on the notices before final action is taken.

Governor Hutchinson intends to grant pardons to the following people:

Teresa Apple (Mountain View): Conspiracy to Furnish Prohibited Articles (C Felony) (CR 2009-52) and Obstructing Governmental Operations (A Misdemeanor) (CR 2009-42).

This notice is issued based on the date of convictions (2010 – Stone County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

George Broady, Jr. (Stuttgart): Non-Support more than $10,000 (C Felony) (CR 2004-71).

This notice is issued based on the date of conviction (2004 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. The Prosecuting Attorney has raised objections to the applicant’s request.

Sheena Casteel Burrow (Jessieville): Possession of Controlled Substance, Methamphetamine (C Felony) (CR-2006-1000); Forgery II (C Felony) (CR-2006-375-3).

This notice is issued based on the dates of convictions (2006 – Pulaski County; 2007 – Saline County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Richard Davis (New Edinburg): Conspiracy to Manufacture a Controlled Substance-Crystal Methamphetamine (A Felony) and Possession of Drug Paraphernalia (C Felony) (CR 2004-31).

This notice is issued based on the date of convictions (2004 – Cleveland County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application. 

James Dyer (Van Buren): Overdraft (C Felony) (CR 98-256); Possession of Drug Paraphernalia (C Felony) (CR 2005-80-A).

This notice is issued based on the dates of convictions (1998 and 2006 – Crawford County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

James Flannery (Paragould): Possession Schedule II Controlled Substance (Meth) (C Felony) (CR 2001-04).

This notice is issued based on the date of conviction (2001 – Greene County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Rayni Foltz (Bentonville): Domestic Battery 3rd Degree (Misdemeanor) (CR-08-3936); Possession of Drug Paraphernalia (A Misdemeanor) (CR-08-1802).

This notice is issued based on the dates of convictions (2008 – Washington County; 2008 – Benton County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. The Washington County Sheriff has raised objections to the applicant’s request.

Freddie L. Jordan (Sherwood): Possession of a Controlled Substance-Cocaine (C Felony) and Possession of Drug Paraphernalia (C Felony) (CR 97-4082); Possession of a Controlled Substance-Cocaine (Revocation) (C Felony) and Possession of Drug Paraphernalia (Revocation) (C Felony) (CR 97-4082).

Peter Keyes (Jonesboro): Burglary (B Felony) and Theft of Property (B Felony) (CR 85-5).

This notice is issued based on the date of convictions (1986 – Greene County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Rodney Trusty (Dierks): Criminal Mischief 1st Degree (C Felony) (CR 91-313).

This notice is issued based on the date of conviction (1991 – Miller County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Daniel Walker (Alexander): Possession Controlled Substance Schedule I, II (C Felony) (CR 2000-116).

This notice is issued based on the date of conviction (2000 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. There are no law enforcement objections to the application.

Governor Hutchinson intends to grant the restoration of firearms right only to the following person:

Montinique N. Gillespie (Little Rock): Fraudulent Use of a Credit Card (C Felony) and Theft of Property (C Felony) (CR 02-4257).

This notice is issued based on the date of convictions (2003 – Pulaski County), the fact that all terms of the applicant’s sentence have been completed and there have been no further criminal-law violations. The Sheriff of Pulaski County has signed the Recommendation of the Chief Law Enforcement Officer as required by law. There are no law enforcement objections to the application.
